Google faces lawsuit in U.S. for allegedly selling defected Pixel smartphones

Seeing consumers launch class action lawsuits against giant companies is a relatively common thing, and today, Google is in the crosshairs. Instead of customers being irate over Pixel 2 issues, users are now suing Google over defects in that phone's predecessors, the 2016 Pixel and Pixel XL. In the complaint, the users alleged that Google sold defective Pixel and Pixel XL units, with some having issues with the warranty of the devices as well. The warranty terms say that the company "will in its sole discretion and to the extent permitted by law either fix your Phone using new or refurbished parts, replace your Phone with a new or refurbished Phone functionally at least equivalent to yours, or accept the return of the Phone in exchange for a refund of the purchase price you paid for the Phone".

Girard Gibbs LLP, the same law firm that was behind a lawsuit against LG over bootloop issues, is behind the Google lawsuit. The Pixel 2 and Pixel 2 XL have been reported to have issues in voice messaging, speaker performance, bundled headphone adapters, fingerprint sensor performance, and audio performance. The suit alleges that Google failed to properly disclose the Pixel's defective microphone, while also improperly responding to warranty claims by replacing defective units with new or refurbished phones that also had defective microphones.

"It promoted the Pixel phones as premium products and priced them from $649 to $869", plaintiffs Patricia Weeks from Florida and Waleed Anbar from California said. We'll see how this one turns out for Google, but if it was refusing warranty replacements for defective phones, this may end up being a cut and dry case.
