Allahabad High Court acquits Talwars

The HC, while upholding the appeals by the Talwars against the Ghaziabad CBI court order sentencing them to life imprisonment on November 26, 2013, said that as per the circumstances and the evidence on record, the dentist couple could not be held guilty.

The Allahabad High Court has acquitted the dentist couple Rajesh and Nupur Talwar in the sensational 2008 Aarushi murder case.

A high court bench, comprising Justice B.K. Narayana and Justice A.K. Mishra, had reserved its verdict, in September, in the appeal filed by Aarushi's parents, who were sentenced to life in jail. It was found that Aarushi was murdered using a surgical knife and her throat was slit.

The police then began to suspect the Talwars and said Rajesh had murdered the two after finding them in an "objectionable" position.

The Allahabad High Court has acquitted the Talwars in the Aarushi murder case. Their domestic help Hemraj was nowhere to be found, making him the suspect, till the next day when he was found on the roof of the apartment building in Noida near Delhi.

Former Jammu and Kashmir chief minister Omar Abdullah said on Tuesday the police made a "total dog's breakfast" of the investigation in the Aarushi murder case. All of which highlights that there were several loopholes in the case, which if prevented would have not only shortened the trial but also ensured swifter justice to Aarushi, something that now seems unlikely. However, there was no material or forensic evidence to validate their claims. A series of lapses marked the investigation, both when it was handled originally by the Noida police and then by the CBI.

Vijay Shanker, who was the CBI Director in 2008 when CBI took over the Aarushi-Hemraj double murder stated that "destruction of evidence started the moment the crime was committed and continued".

On June 13, Rajesh Talwar's compounder Krishna was arrested by the CBI.

Rajesh Talwar underwent a narco- analysis test from February 15 to February 20, but even this did not yield any new information.

CBI submitted a closure report on the case in December, 2010 on the basis of "insufficient evidence".

The Allahabad High Court is likely to pronounce the verdict at around 2 pm. The chain of evidence they have showcased is inconclusive.

While passing the order, the court reversed the verdict of the CBI court which had convicted the Talwars.
